Albuquerque man sentenced to 4.5 years probation for child abuse

ALBUQUERQUE, N.M. (KRQE) – A parent accused of child abuse after one of their children overdosed on fentanyl took a plea deal and was sentenced Wednesday. The Albuquerque Police Department was called to the home of David Olivas and Chanel Gallegos in May 2023 because their child was unconscious.

Doctors determined the child had overdosed and had to use Narcan to revive him. APD found a baggie of fentanyl in an open area that was accessible to both children in the home.

Olivas pleaded no contest to child abuse not resulting in death, and possession of a controlled substance. Judge Bruce Fox sentenced him to four and a half years of supervised release. Gallegos has pleaded not guilty to multiple child abuse charges.
